TERMS AND CONDITIONS OF USE OF THE WEBSITE AND CONFIDENTIALITY POLICY

This website is managed by CGN SA, Avenue de Rhodanie 17, 1007 Lausanne. Please read the following information that explains the management of your personal data and sets out the terms and conditions of use of the website.

I. INTELLECTUAL PROPERTY

II. COLLECTION AND USE OF PERSONAL DATA

By using our services you are aware to we gather, use and share some of your personal data pursuant to the following provisions. We only collect data when this is necessary for the use of our services and the optimisation of the website.   Children under the age of 16 years are not authorised to create a user profile or to make online purchases without the agreement of a legal representative.

a) Data collected and purposes of processing

We collect and process various types of data so that you can enjoy an optimal browsing experience on our website. We do not collect data relating to the most intimate areas of your life (information on your health or relating to your religion, etc.).   For some of our services, or in relation to these, we record data concerning you, notably your first name, surname, IP address, email address, password, phone number, bank details, full postal address, username, password, and the purchases that you make on the website. This data is collected:  

• when a user account is created in order to save your information and to keep them to facilitate the access to our services and your purchases; or
• when an online purchase is made in order to satisfy your purchase and communicate with you regarding your purchase.

For statistical purposes, and only in an anonymous form, we collect data relating to the way in which you use the website, the frequency of your visits and the intensity of your use of the website, such as the date and time of your visit, your originating server’s IP address, how long you are connected to the online store or your purchase behaviour. These statistics are intended solely for internal use and are notably collected:

• when you visit the website www.cgn-exclusive.ch; or
• when you visit the online store.

b) Advertisements and newsletters

When you register on www.cgn-exclusive.ch or make a purchase in the CGN SA online store, you can consent to your personal data being used for advertising purposes, for instance for sending emails containing general information or with an advertising content, and for sending personalised offers.   When you subscribe to the newsletters, your email address and your authorisation are kept for our own advertising purposes, until you unsubscribe to the newsletter.   Should you subscribe to the newsletter, you authorise us to mandate third parties for the deployment of advertising campaigns and to transmit your personal data to them for this purpose.  If you have subscribed to the newsletter, your behavioural activities are collected so that we can determine statistically the opening and clicking rate.  If you do not wish such information to be collected, you may at any time unsubscribe to the newsletter.   Finally, if you have made a purchase via our online store, your email address is used to propose similar articles. Such proposals do not result from profiling, since we limit our proposals to suggestions of purchases based solely on the purchases that you have previously made in the store. In any case, you can have such messages stopped at any time.

c) Recipients of the collected data

Your personal data may be transmitted to third parties if we wish to assert a right before a judicial or administrative authority, when we have recourse to sub-contractors or when this is necessary to respect our contractual obligations to you. Your personal data may be transmitted abroad, on condition that the recipient State is deemed to ensure an appropriate level of protection, according to the Swiss Federal Data Protection Commissioner, or that this transfer is made in the context of an international treaty with this State. Furthermore, we do not sell any of your personal data.

d) Storage of your personal data

We only store your personal data for the time that is strictly necessary for the data to undergo the processing for which it was collected, in the respect of our legal obligations.

e) Security of your personal data

We take suitable measures, both at technical level and in our organisation, to protect your personal data from any manipulation, total or partial loss, or unauthorised access by third parties. Our security measures are regularly adapted to technological developments and improved accordingly.   When you create an account in our online store, you may access it by entering your personal password. It is incumbent on you to ensure your payment information is processed in a confidential way. 

f) Your rights

You may, at any time, request us to provide you with information on the personal data kept by us and consult or modify this data by connecting to your customer account. A formal request must be made in writing with proof of your identity for any modification that cannot be made online. You may also at any time request the deletion of your customer account and the data related or modification of the data. To do this; you just need to send us an email at info@cgn.ch We remind you that in this case you will no longer be able to use all the services of our online store.

III. COLLECTION OF DATA RELATING TO TRAFFIC

Various types of cookies are present on our website (see table). Cookies can be useful in many ways to make your visit to your online store simpler, more pleasant and more pertinent. Cookies are data files that your browser automatically saves on your computer’s hard drive when you visit our online store. For instance, we use cookies to be able to identify you as a registered user, without you needing to reconnect.   Some of these cookies are placed and managed by third parties. These are mainly advertising cookies. In principle, these cookies contain data that does not allow you to be identified directly.   The majority of WEB browsers automatically accept cookies. b) Google Analytics

We use Google Analytics to optimise the design and presentation of our online store. Information linked to your activity on the website is transmitted to the servers of Google Inc. in the US, which records it. Such information may be your IP address, the time of the visit to the webpage, your web browser, your appliance (workstation, device), etc.  It is used for statistical purposes, in order to know the activity of the online store and for market surveys. Google Inc. affirms that it never makes the link between the IP address and the other data concerning the user. According to Google Inc, the IP addresses are masked, and therefore made anonymous. c) Social Plugins

Our pages use Facebook Social Plugins to personalise our online store. For this purpose, we use the “I like” or “share” button. This is a service of the US firm Facebook Inc (1601 S. California Ave, Palo Alto, CA 94304, USA).   Facebook may use this information for market surveys, advertising and personalised presentation of Facebook pages. a) Applications ou technologies gérées par des tiers

You are aware that browsing the web entails certain risks that we are not able to control. In particular, we do not control third parties’ applications or other technologies for tracking, even if they are present on our website or in our advertisements. The confidentiality policies of these third parties must be consulted. We decline all liability in the case of loss or damage caused by third parties’ applications or other technologies for tracking.

b) In the case of a cyber-attack

In the case of a cyber-attack, we decline all liability in the case of loss or damage caused by this intrusion, except in the case of serious negligence.

c) Payment information

In the case of payment via the Internet (online payment), you bear all loss or damage resulting from the use of your debt or credit card, in particular for lack of authorisation, insufficient knowledge of the system or fraudulent use of a debit or credit card.

d) Links to other websites

The website contains hypertext links to other sites that do not belong to CGN. Consequently, we cannot be held liable for the content or functioning of these sites, or for any loss or damage resulting from the use of these sites. Users therefore connect to these websites at their own risks.

e) Modifications to the conditions

We may modify these terms and conditions at any time. In the case of such a modification, you will be appropriately notified, for instance on our website's home page.

f) Applicable law and competent courts

In the case of litigation, only the courts of Lausanne (Switzerland) are competent and Swiss law is applicable.
